Wage and Hour

California Wage and Hour Attorneys

The attorneys at the Brown Gitt Law Group, ALC, are pleased to assist employers with wage and hour matters that may arise in the course of business. A wage and hour matter will typically manifest itself when a disgruntled employee feels he or she has not been sufficiently compensated or reimbursed for his or her work efforts. Employees frequently claim they have worked off the clock in order to finish their work under the direct or implicit direction of the employer, or that they were denied all rest and meal breaks, or did know they could take breaks, or that they were not paid all compensation owed to them at the time of termination.

Often, a wage and hour matter will be raised by an employee who has been terminated, or laid off, or is anticipating the possibility of losing his or her job. Another frequent cause of wage and hour complaints is overtime pay disputes.

Because of the substantial (some would say draconian) and pyramided policies for even small discrepancies, and wage discrepancy for as little as $100 may lead to thousands of dollars of penalties and attorneys fees. These claims make close attention to wage hour laws mandatory to minimize liability and distraction.

Having clear overtime pay, vacation pay, rules on meal and rest breaks, non-retaliation and employee reimbursement policies incorporated into employee contracts are important first steps in preventing wage and hour disputes. These policies also should be prominently posted.

The wage and hour attorneys at the Brown Gitt Law Group have substantial experience in this area, beginning with experience at the solicitor's office at the United States Department of Labor and numerous appearances before the Department of Labor Standards Enforcement and of course, litigation in courts, whether on individual claims or class actions or Private Attorney General Act (“PAGA”) cases. Brown Gitt Law Group provides legal services designed to prevent wage and hour disputes, or, if a wage and hour dispute occurs, with dispute resolution and, if necessary, litigation.
